Anand Marriage registration

It provides statutory recognition to marriage rituals of Sikh community in India. The emergence of the Anand Marriage Act dates back to 1909 when the British Imperial Legislative Council passed a legislation for the recognition of the Sikh wedding ceremony Anand Karaj. The Act aimed to acknowledge and respect the customs and practices of the community. In 2012, the Parliament passed the Anand Marriage (Amendment) Bill, bringing Sikh traditional marriages under the purview of legal recognition.

Eligibility for Marriage Registration under the Anand Marriage Act

Religion:
The act applies exclusively to Sikhs. Both the bride and groom must belong to the Sikh religion and follow Sikh customs.

Ceremony:
The marriage must be solemnized by the Anand Karaj ceremony, which is a traditional Sikh wedding rite conducted in the presence of the Guru Granth Sahib (the Sikh holy scripture).

Age:
The bridegroom must be at least 21 years old, and the bride must be at least 18 years old, in accordance with the legal age of marriage in India.

Consent:
Both parties must give free and voluntary consent to the marriage. Any coercion or fraud would render the marriage invalid.

Marital Status:
Both parties must be unmarried at the time of marriage. If previously married, they should either be divorced or widowed.

Registration:
Though the Anand Marriage Act recognizes the Anand Karaj ceremony, marriage registration is essential to provide legal proof of marriage. Registration is done at the local Registrar’s office after the ceremony has been performed.

The Anand Marriage (Amendment) Bill of 2012 allowed Sikhs to register their marriages under this act instead of under the Hindu Marriage Act, thereby granting a distinct identity to Sikh marriages.
